Reproductive Health and Freedom Watch Statement on SCOTUS ruling in First Choice Women’s Resource Centers, Inc. v. Davenport

The Supreme Court’s ruling in First Choice Women’s Resource Centers, Inc. v. Davenport addresses a narrow question—donor disclosure—not the broader substance of New Jersey’s investigation into patient safety at the pregnancy clinics First Choice operates in the state. First Choice, an unregulated pregnancy clinic with multiple locations in New Jersey that promotes a wide range of “free” medical services, chose to center its case entirely on the donor issue. But the Attorney General’s original inquiry was far more expansive, encompassing more than two dozen outstanding questions about First Choice operations, including who is providing medical services, what credentials they hold, how ultrasounds are performed and interpreted, and what safeguards are in place to protect patient privacy and ensure adequate training.
